JOB LOCATION: Johannesburg

 

REPORTS TO: Group Commercial Director

 

SUMMARY OF EXECUTIVE OPPORTUNITY:

To act as principal advisor to the Group's Executive Committee and Board of Directors on the strategic management of legal matters related to all contractual agreements and claims on mega-projects throughout the lifecycle of projects. To collaborate with the Group Executive to anticipate and identify potential legal impacts on the Group

KEY EXECUTIVE ATTRIBUTES REQUIRED:

  • Must have a Honours/Masters degree in Law
  • At least fifteen years post qualifying experience, ideally with the last five years dealing with senior management on complex contractual legal issues
  • Must have an in-depth knowledge of the Law of Contracts and be familiar with FIDIC and its application in a mega-project management/contracting environment
  • Litigation experience

 

KEY JOB PERFORMANCE AREAS:

  • Play a directive role in guiding both the internal and external professional legal teams to obtain suitable legal support in managing legal, claim and contractual matters, particularly on mega-projects
  • Able to navigate the Public Finance Management Act
  • Act as key advisor to business unit executives during review of contractual strategies and claims processes
  • Effective implementation of the Legal Risk Control Framework across the Group including the requirement that business needs to be conducted in accordance with applicable laws and regulations, contractual arrangements, use of external legal advice and management of litigation
  • Ensure the effective operation of internal forums and governance committees used for Legal and Regulatory Risk and Compliance
  • Define the strategic objectives for the Group Legal Function
